You want to sublet your flat temporarily (a stay abroad, a sabbatical, an internship) and do not know whether the management even has to allow it.

In Switzerland subletting is permitted in principle, the management has to consent and may not reject a sublet arbitrarily. Commonly cited grounds for refusal are: an unreasonable sublet rent, an unreasonable subtenant or significant disadvantages for the landlord. In individual cases legal details can be decisive. The consent should be obtained in writing, with concrete details on the rent, the duration and the person of the subtenant.

What should you do now?
Step 1: Find a candidate subtenant (obtain their application documents).
Step 2: Set the sublet rent (not higher than your own proportional rent plus utility costs).
Step 3: Send a written request to the property management with all the details.
Step 4: Wait for consent (the property management has to reply in good time).
Step 5: Conclude a sublet agreement with the subtenant (in writing).
Step 6: Create a handover protocol with the subtenant.
Step 7: During the sublet: stay in regular contact, you remain the main tenant and therefore liable.

Common mistakes
- Subletting without the property management's consent, this can become formally tricky.
- A sublet rent clearly above your own rent can count as an impermissibly high sublet rent, consent can be withdrawn.
- No written sublet agreement, no proof in case of a dispute.
- Forgetting the handover protocol. Damage caused by the subtenant remains unclearly attributed.
- Insurer not informed. The household contents policy may not apply in case of damage.

„The tenant may sublet the apartment in whole or in part with the landlord's consent. The landlord may refuse consent only if the tenant does not disclose the conditions, if these are abusive compared with the main contract, or if the sublet causes the landlord significant disadvantages."
