Terms for use and rental through BoVita
1. Scope of Application
These Terms and Conditions govern the use of the website as well as all inquiries, reservations, and rental relationships established through BoVita. By using the website and/or submitting an inquiry, users accept these terms. The provisions of the Swiss Code of Obligations (OR) and the individual agreements in the respective rental contract also apply.
2. Service Offer
BoVita offers furnished rooms in shared apartments at various locations in Switzerland. The rental price includes:
- Use of the furnished room (including inventory as per property description)
- Shared use of common areas (kitchen, bathroom, living room, laundry room, possibly parking)
- Utility costs (heating, electricity, water, sewage, internet)
- Defined services (cleaning service for common areas, support, maintenance)
Not included:
- Personal insurance (e.g., liability or household insurance)
- Legal fees such as the Serafe broadcasting fee
3. Inquiry, Reservation and Contract Conclusion
- Inquiries via the website are non-binding.
- A rental relationship is only established by signing a written rental or sublease agreement.
- BoVita may reject inquiries at any time without giving reasons.
- Reservations are only binding after written confirmation.
4. Rent and Deposit
- The rent includes gross rent including utilities and defined services.
- The rent is due monthly in advance, no later than the 1st calendar day of the month.
- A rental deposit (usually two months' rent) must be paid before the start of the rental. This can be provided as a bank deposit or rental deposit insurance.
- The deposit will be refunded after proper return of the rental property and settlement.
5. Rental Duration and Termination
- A contractually agreed minimum rental period applies. During this period, ordinary termination is excluded.
- After the minimum rental period, the rental relationship is automatically extended unless terminated in writing with the agreed notice period (usually three months to the end of the month).
- Terminations must be made in writing and by registered mail.
- The right to extraordinary termination for important reasons (e.g., repeated payment default, serious contract violations) remains reserved.
6. Tenant Obligations
Tenants commit to careful and contractual use of the rental property, in particular:
- Compliance with house rules
- Careful handling of inventory and common areas
- Immediate reporting of damage or defects
- No structural changes without written consent
- No subletting or permanent accommodation of third parties without permission
- Conclusion and proof of private liability insurance with sufficient coverage
7. Visitor Policy
- Short-term visits and occasional overnight stays (1-2 nights) are permitted.
- Longer stays (more than two nights per week) require the consent of BoVita and the roommates.
- Permanent accommodation of guests is prohibited.
- Tenants are liable for the behavior of their visitors.
8. Liability
- Tenants are liable for all damages caused by them or their visitors.
- BoVita is only liable for damages caused by intentional or grossly negligent behavior by BoVita or commissioned third parties.
- Liability for slight negligence, indirect damages, or tenant property is excluded to the extent permitted by law.
- Tenants are required to insure their personal belongings themselves (household insurance recommended).
9. Data Protection
BoVita processes personal data in accordance with the Swiss Data Protection Act (revDSG).
- Data is used exclusively for processing inquiries, contract handling, and legal obligations.
- Disclosure only occurs if necessary for contract fulfillment or legally required.
- Data subjects have the right to information, correction, and deletion of their data within the framework of legal requirements. Details are regulated in the privacy policy.

10. Reminders and Payment Default
- In case of payment default, reminder fees (CHF 20 per reminder) may be charged.
- After the grace period expires, additional collection costs and default interest (at least 5% p.a.) may be charged.
- BoVita reserves the right to take legal action in case of payment default.
11. Changes to the Terms
BoVita may adjust these Terms and Conditions at any time. Changes will be published on the website and take effect upon publication.
12. Applicable Law and Jurisdiction
- Swiss law applies exclusively.
- The place of jurisdiction is – to the extent legally permissible – the location of the rental property.
- Mandatory legal jurisdictions (e.g., consumer protection) remain reserved.
